These Terms of Service ("Terms") govern your access to and use of Shovel (the "Service"), operated by the Shovel team ("we," "us," or "our"). By creating an account, signing in, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
By accessing or using Shovel you confirm that you are able to form a binding contract with us and that you accept these Terms and our Privacy Policy. We may update these Terms from time to time; material changes will be communicated through the Service or by email, and your continued use after changes take effect constitutes acceptance of the revised Terms.
2. Your Account
To use most features you must create an account. We support passwordless sign-in via magic links sent to your email address (delivered through our email provider) and sign-in with Google. You are responsible for maintaining the security of your account and email inbox, and for all activity that occurs under your account. Notify us promptly of any unauthorized use. You must provide accurate information and keep it up to date.
3. Acceptable Use
You agree not to use the Service to: post or distribute content that is unlawful, infringing, defamatory, harassing, hateful, or otherwise objectionable; impersonate any person or entity; upload malware or attempt to compromise the integrity or security of the Service; scrape, harvest, or collect data in violation of these Terms or applicable law; or interfere with other users' enjoyment of the Service. We may remove content and suspend or terminate accounts that violate these rules.
4. User-Generated Content & License
You retain ownership of the content you create on Shovel, including universes, wikis, posts, comments, and shovels, as well as any images you upload. By submitting content you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, adapt, and distribute that content solely as needed to operate, provide, and promote the Service. You represent that you have the rights necessary to grant this license and that your content does not violate the rights of any third party. Because much content on Shovel is collaborative, you also grant other users the rights described in any applicable contribution or licensing settings shown in the Service.
5. Our Intellectual Property
The Service itself, including its software, design, logos, and trademarks, is owned by us or our licensors and is protected by intellectual property laws. Except for the rights expressly granted to you in these Terms, we reserve all rights in and to the Service. You may not copy, modify, or create derivative works of the Service without our prior written permission.
6. Termination
You may stop using the Service and request deletion of your account at any time (see our Privacy Policy for how to do so). We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms, if required by law, or if we discontinue the Service. Upon termination, the licenses you granted for content already shared with other users or incorporated into collaborative works may survive to the extent necessary to preserve that shared content.
7. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any content is accurate or reliable. You use the Service at your own risk.
8. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months preceding the claim or one hundred United States dollars.
9. Governing Law
